The Supreme Court has struck out a case filed by the National Youth Organiser of the National Democratic Congress (NDC), Mr Edem Agbana, in which he prayed the apex court to compel the CEO of the Ghana National Petroleum Corporation (GNPC), Dr Kofi Kodua Sarpong, to resign from office on grounds that the 65-year-old, as of the time of filing the suit, had crossed the acceptable retirement age.

The court’s action followed a decision by Mr Agbana, through his lawyer, Mr Kisi Adjabeng, to withdraw the case when the issue was heard on Wednesday, 29 July 2020.

Mr Agbana has argued that the GNPC CEO’s continued stay in office at his age was a breach of Article 199 (1) and (4) of the 1992 Constitution.

He prayed the court to make Dr Sarpong refund to state all emoluments and benefits he had accrued after crossing the retirement age.

Dr Sarpong was appointed by President Akufo-Addo in February 2017, as acting CEO.

He replaced Mr Alex Mould who had served as CEO since 2013.

Until his appointment, Dr Sarpong was the Chair of the Board of Directors of Royal Bank.

Dr Sarpong has served in a number of executive, non-executive and advisory positions in many organisations, including the GCB Bank, the Merchant Bank among others.

Dr Sarpong is a Chartered Accountant, and holds a PhD in Industrial and Business Studies from the University of Warwick; M.Acc in International Accounting and Finance from the University of Glasgow.

Dr Sarpong is also an alumnus of the University of Ghana Business School having obtained his MBA and B.Sc (Administration) in Accounting, from the school.
