'Akwaaba (Welcome)' and 'Welcome to Africa': Alabaster Box sues Medikal for GHS10m

Ghanaian a cappella group Alabaster Box has sued rapper Medikal, born Samuel Adu Frimpong, for using a portion of their Akwaaba (Welcome) song illegally.

Alabaster Box’s legal representatives informed Medikal they had observed the reproduction of a portion of the said song at the beginning of his new release titled Welcome to Africa.

They demanded Medikal promptly removed Welcome to Africa from all traditional and digital platforms, adding the rapper had to end, among other things, the marketing and performance of the song.

In an escalation, Alabaster Box has sued Medikal for GHS10 million in general damages.

The writ of summons, signed by Richard Nunekpeku, lawyer for Alabaster Box, noted Medikal following initial warning, Medikal had only deleted the first ten seconds of Welcome to Africa but from only YouTube. The document underlined other streaming platforms like Audiomack, Boomplay, Spotify and Apple Music still had the Akwaaba (Welcome) interpolation at the centre of the controversy.

According to the writ, the deletion of the first 10 seconds of Welcome to Africa on YouTube only and “not contacting us is disrespectful and an admission of guilt”.

For Medikal’s act of infringement, Alabaster Box also demanded exemplary damages of GHS5 million, and another GHS5 million for attaching their respected Gospel brand to vulgar lyrics in Welcome to Africa.
