‘Serious breach of due process’ - CDM demands answers from gov’t over Ofosu Nkansah detention
The Centre for Democratic Movement (CDM) has demanded urgent clarification from the Government regarding the legal status and whereabouts of Mr Kofi Ofosu Nkansah, following his reported detention by the National Intelligence Bureau (NIB).
The group described the circumstances of his arrest as alarming and warned that the situation raises serious constitutional concerns.
In a strongly worded statement, the CDM said Mr Ofosu Nkansah, former CEO of the National Entrepreneurship and Innovation Programme (NEIP), had initially cooperated fully with investigators.
It stated that he voluntarily appeared before the NIB on February 5, with his lawyer to assist with an inquiry and was subsequently asked to leave without charge.
The group recounted that on February 9, Mr Ofosu Nkansah sought to reschedule a reporting date from February 10 to February 11 due to a critically ill parent.
According to the CDM, he honoured the revised arrangement.
However, upon reporting, he was allegedly escorted to his residence for a search “without a valid warrant presented” and later transported to an undisclosed location, with his legal team unable to determine where he was being held.
“While CDM acknowledges the mandate of state investigative agencies, the circumstances of Mr Nkansah’s treatment constitute a serious breach of due process and fundamental rights,” the statement said.
It emphasised that Ghana’s democracy is anchored on the rule of law, separation of powers, and respect for human rights, adding that “no one should face arbitrary detention or coercion without statutory and judicial oversight.”
The CDM therefore called on the Presidency and other state institutions to ensure that investigative bodies operate independently and within constitutional bounds.
It further urged that “all investigations respect due process, transparency, and the rights of persons involved,” insisting that the rule of law remains indispensable to democratic governance.
