Chief Justice Gertrude Torkornoo has requested a response from Special Prosecutor Kissi Agyebeng regarding a petition from his predecessor, Mr Martin Amidu, which seeks his removal from office.
The Chief Justice's letter, dated Thursday, 16 May 2024, aims to determine whether there is a prima facie case against Mr. Agyebeng.
“This is to forward to you a copy of the petition dated 30th April 2024, sent to the Office of the President and subsequently forwarded to the Office of the Honourable Lady Chief Justice on 6th May 2024. Kindly provide your comments on the matters raised to enable the Honourable Chief Justice to determine if a prima facie case has been made out,” the letter stated.
On April 30, 2024, Mr. Amidu, also a former Attorney General and Minister of Justice, petitioned President Nana Addo Dankwa Akufo-Addo, seeking the impeachment of Mr. Agyebeng as head of the anti-graft agency. President Akufo-Addo forwarded the petition to the Chief Justice on May 6 for action pursuant to the Office of the Special Prosecutor Act, 2017 (Act 959).
Although the content of the petition has not been publicly disclosed, information indicates that Mr. Amidu's grounds include allegations of procurement breaches at the Office of the Special Prosecutor (OSP), unlawful appointment of personnel, violations of individuals' rights regarding arrest, and actions bringing the justice system into disrepute.
The latter allegation is believed to refer to a November 2023 press conference where Mr. Agyebeng accused some judges of being "dismissive" of his office's work, which he claimed hindered the fight against corruption.
