The elder (Abusuapanin) of the Fosuh family, Kofi Owusu, will determine who performs the widowhood rites for the late Highlife icon Charles Kwadwo 'Daddy Lumba' Fosuh, the family's lawyer has said.
This came after the High Court in Kumasi dismissed an interlocutory injunction application filed by Mrs Akosua Serwaa Fosuh, Lumba's German wife, whose legal status as wife and widow has been verified and confirmed by the German Embassy, Accra.
She had sought to bar Lumba's extended family from carrying out the said rites, ahead of some matters she held important being determined.
According to her, the singer's family had kept her in the dark concerning his funeral arrangements. Rather, they appeared to be handling the business with a woman called Odo Broni, who identified herself as the musician's wife.
"This is a decision that will be made by the family. That is a determination that the court has declined to make a pronouncement on. It is the family, led by the Abusuapanin, who will decide who performs the widowhood rite," the Fosuh family lawyer explained.
In her ruling on Tuesday, October 28, 2025, Presiding Judge Dorinda Smith Arthur recognised that the authority over a corpse rested entirely with the family, per Ghanaian customary law.
Additionally, barring the family from carrying out the funeral rites, the court said, would not serve the best interests of the Fosuh family, and the general public.
Judge Dorinda Smith Arthur said, "Accordingly, the application for interlocutory injunction is hereby refused."
William Kusi ESQ led the legal representation for Akosua Serwaa.
Daddy Lumba's fineral rites were scheduled by his family for Saturday, December 6, 2025.
