Speaker fails to file ‘no case’ statement in vacant seats case
The Speaker of Parliament Alban Bagbin has missed a critical deadline to file his statement in the Supreme Court regarding the case challenging the legality of declaring parliamentary seats vacant when MPs declare independence.
On Monday, 11 November 2024, the court noted the absence of representation from the Speaker’s side, despite previously granting an extension for him to file by Wednesday, 6 November 2024.
The case, brought forward by New Patriotic Party (NPP) caucus leader Alexander Afenyo-Markin, centres on the eligibility of certain Members of Parliament to retain their seats after declaring intentions to run as independents.
The Speaker’s legal counsel, Thaddeus Sory, had previously requested extra time, citing the need to consult extensively with Speaker Bagbin to prepare a thorough response.
However, even after the extended deadline, no statement of case was filed, leaving questions about the Speaker’s position and approach to the issue.
In response, Attorney-General Godfred Dame argued that the Speaker’s involvement in the case may not be essential, asserting that the Attorney-General’s office is fully authorised to handle constitutional matters on behalf of public officials.
Mr.Dame urged the court to proceed with the hearing, arguing that further delays would only hamper the legal process and prolong uncertainties regarding parliamentary representation.
